Terms & Conditions

Fairhall Solutions desires to make its clients’ online business a success and will contribute in all the best possible manners to ensure a productive outcome. We stand committed to make the proposed solution a great success and will leave no stone unturned to ensure the same. We will keep adding suitable features in due course of time and most of them will be available to existing subscribers at no extra costs. We appreciate the faith imposed by our clients by subscribing to our solution and in order to ensure more transparency in the matter we have carefully drafted the agreement below. We assure that we will always look to work closely with our subscribers and ensure value addition progressively.

  1. Nijees is a SAAS (Software as as service) platform, developed by Fairhall Solutions, which allows subscribed users to manage their Ecommerce site/ Virtual Showroom and sell/display their products/ services online on a DIY (do-it-yourself) basis. The solution comes with two online payment gateways integrated with Payu and PayTm and also offers the option of COD(Cash on delivery) at the time of checkout(in E-commerce mode only). Subscribers get an admin panel to manage their online store.
  2. The charges for 1 year subscription of E-commerce websites are INR 12,000/- and INR 7,000/- for Virtual Showroom, payable in advance only.
  3. The subscription charges are applicable for 1 site only and incase subscriber wishes to host on multiple sites, then additional subscriptions are to be purchased. Domain registration / renewals to be charged extra as applicable.
  4. Applicable GST to be charged additionally over the above mentioned charges.
  5. All payments to be made in favor of Fairhall Solutions.
  6. Once subscribed, the amount paid towards subscription fee is non refundable.
  7. Subscribing for an E-Commerce/ Virtual Showroom site allows the user to use the website as a SAAS hosted solution only and does not entitle ownership or any other sorts of rights to the user.
  8. The subscription is valid for 1 year from the date of payment confirmation and in order to continue the site usage after 1 year, users will have to renew the subscription 15 days prior to expiry date.
  9. Any additional work to be done will be charged separately. (Pls. Refer to Annexure 1)
  10. The content (images, product information) for the website, shall be sole liability of the client and any disputes related to the same shall be sole responsibility of the subscriber.
  11. The subscriber will have to create his account on respective payment gateways and complete all the required formalities as per the policies of the respective payment gateway companies.
  12. All policies related to payment gateway (a third party service) shall prevail and Fairhall is only an integrator and shall not be liable for any disputes between payment gateway and the subscriber.
  13. Subscribers are liable for providing services/ products sold/displayed on the platform on their own and Fairhall shall not have any role in their business operations unless mentioned and agreed upon in a separate agreement/ MOU. Any legal dispute arising from any product/service of subscriber and their clients shall have no bearings on Fairhall Solutions.
  14. Fairhall reserves its rights to suspend/cancel any subscription if any foul play or malpractice/misuse is identified/reported on sites hosted on our platform at any point of time or upon intimation/order/request by any government authorities with valid and binding instructions, without any scope of liabilities/penalties on Fairhall.
  15. Any additional services required by the client shall be discussed and agreed upon by the subscriber and Fairhall in written and no verbal commitment shall be considered.
  16. Fairhall reserves its rights to revise the subscription charges at any point of time. Most of our updates will be inclusive in the base subscription charges but as a policy we retain the right to introduce add-on modules / services from time to time. These services will be optional and in no way affect the ongoing subscription of the user.
  17. Fairhall reserves its rights to offer and / or discontinue discounts on subscriptions from time to time as deemed appropriate by the company.
  18. Fairhall, as its product policy, will keep adding/updating features on the portals to make user experience progressively better. In rare cases, despite proper testing/evaluations, code might get affected and functions of the site get affected briefly. If subscribers come across any such incident, they shall inform the support team of Fairhall in order for immediate assistance on the same without any liabilities on Fairhall.
  19. As a standard practice Fairhall undertakes all required steps to ensure safety of the sites/servers, however if the site goes down due to any unforeseen circumstances and not limited to unethical hacking attempt, hardware failure, server software failure, any manual / auto scripted attacks, virus/malware/bots intrusions/ attacks, server spiking scripts etc, Fairhall will require a reasonable time to address the issue without any liabilities/ penalties. It is observed that, at times, server companies themselves take a good amount of time to identify and suggest remedies or apply / recommend fixes, the sites can become unavailable to the public for the same reasons without any liabilities/penalties on Fairhall Solutions.
  20. Subscribers undertake that they shall not post any information in social media, public platforms, community groups, blogs etc which is defamatory, demeaning for Fairhall Solutions, Nijees, any of its employee, associate or partner, publicly, at any time during or subsequent to subscription period.
  21. All disputes are subject to Delhi Jurisdiction only.

Exclusions

  • Media, content for subscribers of E-commerce / Virtual Showroom 
  • Data management
  • Search Engine Optimization
  • Paid promotions
  • Corporate Email services
  • Any services which are not mentioned in inclusions
  • Any features which are not mention in features section of the annexure
  • However if a subscriber wishes to avail any additional services, the same can be discussed and agreed upon in an add-on agreement/ MOU written and signed by both parties, from time to time.
